These Terms and Conditions ("Terms") govern your use of the website operated by Advanced Beaumont Deck & Fence at beaumontdeckandfence.com and your engagement with our services. By accessing our website or contracting with us for services, you agree to these Terms. If you do not agree, please do not use our website or engage our services.
By visiting beaumontdeckandfence.com, submitting a contact form, requesting an estimate, or entering into a written service agreement with Advanced Beaumont Deck & Fence, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms apply to all visitors, customers, and others who access our website or use our services.
Advanced Beaumont Deck & Fence provides deck construction, fence installation, pergola installation, outdoor living structure construction, and related services for residential properties in Southeast Texas. Our services include, but are not limited to, custom deck design and build, composite and wood deck installation, deck repair and replacement, vinyl and wood fence installation, screened-in porches, covered decks and patio covers, and deck staining and sealing.
We reserve the right to refuse service to any person or property at our sole discretion.
All estimates provided by Advanced Beaumont Deck & Fence are based on the scope of work described at the time of the estimate. Written estimates are valid for 30 days from the date of issuance unless otherwise noted. An estimate is not a binding contract until a written service agreement is signed by both parties.
Prices may change if the scope of work changes after the estimate is accepted, if materials costs change significantly before work begins, or if unforeseen conditions are discovered during construction (such as rotted framing, unstable soil, or pre-existing structural issues). Any change to the agreed price will be communicated to you in writing before additional work proceeds.
Permit fees charged by local jurisdictions are separate from labor and material costs and will be listed in your written estimate.
Project start dates are subject to permitting timelines, material availability, and our current schedule. We will communicate a projected start date after a signed agreement and deposit are received. We are not responsible for delays caused by permit offices, material suppliers, weather, or other factors outside our control.
If you need to cancel a scheduled project, please notify us in writing as soon as possible. Deposits may be non-refundable depending on the stage of the project, including materials already ordered or permit fees already paid. The specific terms for deposits and cancellations will be stated in your written service agreement.
We reserve the right to reschedule work due to unsafe weather conditions, material delays, or other circumstances. We will notify you of any rescheduling as promptly as possible.
Payment terms are outlined in your written service agreement. In general, a deposit is due upon signing the service agreement, with the balance due upon project completion unless otherwise agreed in writing. Payment methods accepted will be specified in the agreement.
If payment is not received by the due date, we reserve the right to stop work and retain all materials and work completed up to that point. Unpaid balances are subject to interest at the maximum rate permitted by Texas law. You agree to pay all reasonable costs of collection, including attorney fees, if your account is referred for collection.
Advanced Beaumont Deck & Fence reserves the right to file a mechanic's lien on the property in the event of non-payment, as permitted under Texas law.
Where required by local ordinance, Advanced Beaumont Deck & Fence will obtain applicable building permits on your behalf as part of the project. You agree to provide access to the property and any required documentation to support the permit application process.
You are responsible for ensuring your project complies with any homeowners association (HOA) rules or deed restrictions that apply to your property. We will cooperate with HOA approval requirements if notified in advance, but obtaining HOA approval is your responsibility.
Advanced Beaumont Deck & Fence warrants that all work will be performed in a workmanlike manner consistent with industry standards. Any warranty specific to your project will be stated in your written service agreement.
Material warranties are provided by the respective manufacturers and are separate from any workmanship warranty we offer. We will assist you in pursuing manufacturer warranty claims but are not responsible for fulfilling manufacturer obligations.
Our warranties do not cover damage caused by acts of nature, flooding, improper use or maintenance, modifications made by others, or normal wear and tear. The website and any information provided on it are offered "as is" without warranties of any kind, express or implied.
To the fullest extent permitted by applicable law, Advanced Beaumont Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services provided shall not exceed the amount paid by you for the specific project giving rise to the claim.
You agree to provide our crew with safe and reasonable access to the work area for the duration of the project. This includes ensuring that children, pets, and uninvolved persons are kept away from the active work zone.
You agree to disclose any known underground utilities, hazards, or site conditions that could affect the safety of our crew or the outcome of the work. Failure to disclose known hazards releases Advanced Beaumont Deck & Fence from liability for damages arising from those conditions.
